The two-year limitation period for claiming an eviction indemnity runs from the effective date of the notice to quit. The suspension provided for by Article 2239 of the Civil Code where an expert assessment is ordered before any proceedings benefits only the party that requested it: the defendant tenant can benefit from it only if it expressly joins the request or itself asks for the expert’s remit to be extended or amended; mere objections and reservations are not enough.
