Articles 61 to 63 of Law No. 2026-403 of 26 May 2026 on the simplification of economic life make substantial changes to the commercial lease regime: the scope of the tenant’s right of first refusal, monthly payment of rent at the tenant’s request, “tunnel” provisions in indexation clauses, the cap on and return of the security deposit and other guarantees, and the termination clause and time to pay. These provisions draw distinctions according to the type of premises, which raises the question of whether the promised simplification is real.
