A mayor who fails to defer a decision on an application for planning permission for an agricultural and livestock shed and a manure pit, the scale of which is such as to jeopardise implementation of the local urban development plan (PLU) being drawn up, commits a manifest error of assessment; that illegality justifies the withdrawal of the planning permission obtained tacitly.
