On 4 April 2012 the Paris court of appeal handed down two judgments settling the question of the validity of indexation clauses containing a so-called “fixed” index.
According to the court of appeal, in a contract for successive performance containing an indexation clause, a distinction must be drawn between the indexation clause itself and the clause referring to a base index.
