The statement of case (mémoire) procedure provided for by Article R. 145-24 of the Commercial Code for setting the rent does not require the document sent to the opposing party to bear any particular heading. The Commercial Code does not exclude the application of Article 651 of the Code of Civil Procedure, which allows service by bailiff (1st case).

Notification is valid even where the registered letter with acknowledgement of receipt has not been collected (2nd case).
