AJDI, novembre 2014
The Law of 18 June 2014 does not apply to leases whose renewal, whether agreed or court-ordered, took effect before 1 September 2014, even if the deed is signed after that date: the renewed lease takes effect on the expiry of the previous one, regardless of when the rent is set or the deed signed. Likewise, the abolition of the tenant’s ability to waive its three-yearly right to give notice does not affect such waivers in leases concluded earlier. Finally, the article considers how to calculate the rent cap for leases renewed after 1 September 2014 when the ILC or ILAT indices do not cover the whole term of the expired lease.
