Article 1719 of the Civil Code does not have the effect of requiring the landlord to guarantee the tenant the customer footfall of the leased premises or the stability of the regulatory framework within which its business is conducted. A tenant is therefore not entitled to rely on a failure by the landlord to perform its obligation to deliver the premises in support of its claim for repayment of the rent paid during the lockdown period linked to the Covid-19 epidemic.
