Plan local d'urbanisme et règlement sanitaire départemental

Note sous CAA, Marseille, 25 févr. 2014, n° 12MA02300, Durand - Dr. adm. 2014, comm. 64.

By requiring that, failing a connection to the public drinking water supply network, any new building or installation used for housing or receiving members of the public be supplied by a private water abstraction point authorised by the prefect, the land use plan (POS) regulations do not impose a formal condition but are intended to ensure that the water supplying the buildings for which planning permission is sought meets the health requirements laid down by the departmental health regulations and the Public Health Code.
