L'administration doit-elle tenir compte du droit des tiers lorsqu'elle délivre un certificat d'urbanisme opérationnel ?

Note sous CAA, Bordeaux, 17 décembre 2013, n° 12BX01977, Cne Monségur, Construction Urbanisme 2014, comm. n° 25

A mayor may lawfully issue a negative town planning certificate for the construction of a detached house on a landlocked plot accessible only by a grassy track encumbered, for its benefit, by a mere agricultural right of way, in the absence of the consent of the owner of the servient land to serve the applicant’s plot or of a court decision granting the applicant the right to use that track for a construction project.
