A commercial lease entered into for use as a retirement home and stipulating that the landlord consented to subletting to the operator, as subtenant, cannot be granted for a term of less than nine years, and the tenant is entitled to the benefit of the commercial lease regime, since operation of the premises by the tenant itself was not stipulated as a necessary condition for the application of the statutory regime.
